General Terms & Conditions of Emporium Hamburg Münzhandelsgesellschaft mbH

 

§ 1 Scope

 

1.1

These General Terms & Conditions, together with the law of the Federal Republic of Germany, apply to all business relationships between you as a consumer/end customer and us. For merchants as defined by the German Commercial Code, Our "Conditions of Delivery and Payment for Wholesale" apply exclusively.

 

1.2

These General Terms & Conditions also apply to customers whose place of residence or permanent domicile is outside Germany, as does German law, with the exception of the UN Convention on the International Sale of Goods.

 

§ 2 Offer and conclusion of contract

2.1

You may place an order for the items described in the online shop, in the brochure and/or on the price lists. Our presentation of the items does not constitute a binding offer but a non-binding catalogue showing examples. Errors in the presentation of all products are reserved and the principle "while stocks last" applies.

 

2.2

By clicking the "Buy now" button or submitting an order by e-mail, you are making a legally binding purchase offer for the goods in the shopping basket or in the e-mail. Our confirmation e-mail means that your order has reached us and has been passed on for further processing but does not yet entail the conclusion of a contract.

 

2.3

A purchase contract only comes about with the express acceptance of your purchase offer in the form of an order confirmation sent by e-mail or by delivery of the goods.

 

§ 3 Prices and shipping cost

 

3.1

All prices and shipping costs are given in euros and include statutory VAT. We expressly reserve the right to use differential taxation for individual items, pursuant to § 25a of the German VAT Act. All shipments to foreign locations outside the EU are always made without payment of duties, customs fees or import taxes (you can obtain more detailed information from your tax office). However, no VAT is charged on the items.

 

3.2

The shipping costs are calculated in accordance with the content of the shipment, its value and the shipping method. The shipping costs are shown in the online shop during the order process or they can be provided to you in advance on request.

€90.00 for goods with a value of €20,000.00 or more.

 

In the case of cash on delivery, a further €2.00 is charged by the deliverer, in addition to the cash-on-delivery fee of €4.00.

§ 4 Payment

 

4.1

Payment is made by the method you choose when placing your order. 

 

4.2

In the case of payments by invoice or part payments, the invoice amount is payable and due immediately on receipt of delivery. In the event of default, we are entitled to the statutory default interest in accordance with § 288 of the German Civil Code (BGB) and to an additional processing fee.

 

4.3

If you return the delivery on the basis of your legitimate right of withdrawal, amounts already charged to you will be refunded.

 

4.4

The right to offset is only available to you if your counterclaims are legally established, uncontested or have been accepted by us in writing.

 

4.5

Transaction costs for credit card payments (4.5%) are charged to you.

 

4.6

Payment by direct debit is collected after the due date on the invoice. The customer may set up a SEPA basic mandate / SEPA company mandate for Emporium Hamburg Münzhandelsgesellschaft mbH for payment by finance or direct debit. You undertake to ensure that there are sufficient funds in the account. Costs resulting from non-payment or reverse transfer of the direct debit will be charged to you, unless we are to blame for the non-payment or reverse transfer.

 

4.7

With an invoice total of €300 or more, we accept payment by instalments. We currently charge no interest for payment by instalments. Payment in up to 6 instalments is possible at the moment.

§ 5 Delivery, delivery periods

 

5.1

Essentially, our goods are always shipped; collection from us is only possible by prior arrangement and on an agreed date.

 

5.2

You will be notified of the anticipated shipping date in the course of the order process; if you choose "advance payment" as the payment method, however, you will not be notified until the money is received.

 

5.3

We are entitled to make part deliveries and perform part services, but you will only be charged for shipping and packing once.

 

§ 6 Retention of title

The goods remain our property until full payment has been received.

 

§ 7Withdrawal policy

 

7.1

The following applies to you as a consumer in the sense of § 13 BGB:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without specifying the reasons.

 

The withdrawal period is fourteen days from the day on which you or a third party nominated by you, but who is not the carrier, have taken possession of the last part shipment or the last item.

e.g. a letter by post, a fax or an e-mail, notifying us of your decision to withdraw from this contract. You may use the sample withdrawal form attached for this purpose, but this is not a requirement.

 

You may complete and send the sample withdrawal form or another clear declaration of your intention electronically on our website “Withdrawal form (http://www.emporium-hamburg.com/index.php?id=169)”. If you exercise this option, we will send you a confirmation of receipt of the withdrawal immediately (e.g. by e-mail).

 

To comply with the withdrawal period, it is sufficient to send notification of your intention to exercise your right of withdrawal before the withdrawal period has expired.

 

Consequences of withdrawal

 

If you withdraw from this contract, we must refund to you all payments that we have received from you, including delivery costs (with the exception of additional costs that result from the fact that you have selected a form of delivery that differs from the cheapest standard delivery we offer), immediately and at the latest within fourteen days of the date on which the notification of your withdrawal from this contract was received by us. For this refund, we will use the same payment method that you employed for the original transaction, unless an alternative has been expressly agreed with you; you will not be charged for this refund under any circumstances. We may refuse to make the repayment until we have received the returned goods or until you have provided evidence that you have returned the goods, whichever is the earlier.

 

You must return or handover the goods to us or to [here you should insert the name and address of the person authorised by you to receive the goods, as appropriate] immediately and in any case at the latest within fourteen days of the date on which you notified us of your withdrawal from this contract. To comply with the period, it is sufficient for you to send the goods before the period of fourteen days has expired. We will meet the direct costs of returning the goods.

 

You must only pay for any loss of value of the goods if such loss of value is the result of your handling the goods in a way that was not essential to check their quality, properties and functioning.

 

7.2

Please avoid damage and contamination. If possible, return the goods to us in the original packaging with all accessories and with all components of the package. If you no longer have the original packaging, please ensure that the goods are adequately protected against damage in transit by using suitable packaging, so that you avoid compensation claims for damage based on inadequate packaging.

 

7.3

If we were not able to agree collection with you, please return the goods to us as an insured package and keep the mailing receipt. On request, we will also be happy to refund the shipping costs in advance.

 

7.4

Please note that the courses of action specified in paragraphs 7.2. to 7.3. are not a prerequisite for the legitimate exercise of your right of withdrawal.

 

7.5

There is no right of withdrawal in accordance with § 312 d para. 4 no. 6 BGB if our delivery relates to goods the price of which is subject to fluctuations on the financial market, which may occur during the withdrawal period and over which we, as a company, have no influence.

 

§ 8 Warranty

The warranty meets the statutory provisions.

 

§ 9 Liability

 

9.1

We cannot accept liability for negligent breach of obligations unless such obligations are material to the contract, concern damages resulting from loss of life, physical injury or damage to health, or claims under the German Product Liability Act are affected.

 

9.2

We also cannot accept liability for consequential damages, such as a failure to benefit from increases in value.

 

9.3

All links to external sites were checked carefully by us when our site was created. Potential breaches of the law were not apparent at the time the links were established; we cannot therefore accept liability for external links.

 

§ 10 Data protection, checking of creditworthiness

 

10.1

Data protection is important to us. We have made our data protection policy available under "Data protection (http://www.emporium-hamburg.com/index.php?id=161)" and on the reverse of our invoices.

 

10.2

You may visit our website without providing information about your identity. We only save access data without reference to your identity, such as the name of your internet service provider, the page from which you visit us or the file you access. All of this information is evaluated exclusively to improve our website and cannot be traced back to the person from whom it originates.

 

10.3

Personal details are only collected if you communicate them to us voluntarily when ordering goods, opening a customer account or subscribing to our newsletter.

 

10.4

Your details are passed on to the shipping company appointed to make the delivery, insofar as this is essential for the goods to be delivered. In order to process payments, we pass on your payment details to the financial institution appointed to handle payments for us.

 

10.5

On various pages we use cookies to make visiting our website attractive and to facilitate the use of certain functions. Cookies are small text files that are stored on your computer; however, most of the cookies we use are deleted once your session has ended. Other cookies remain on your computer and enable us to recognise it on your next visit. These so-called permanent cookies enable us to welcome you with your username and mean that you do not have to re-enter your password or fill out forms when you place another order.

 

10.6

If you have subscribed to our e-mail newsletter, we will use your name and your e-mail address for our own advertising purposes until you cancel your subscription to the newsletter.

 

10.7

Under the German Federal Data Protection Act, you have a right to receive information concerning the data saved about you free or charge and, as appropriate, a right to correct, block or delete this data. 10.8

If we perform a service in advance of payment when you register as a new customer, we will collect information about your creditworthiness based on mathematical and statistical processes, in order to protect our legitimate interests. Your interests that are worthy of protection will be taken into consideration in accordance with the statutory provisions. Your details will not be passed on to third parties.

 

§ 11 Concluding provisions

11.1

Should a provision of these General Terms & Conditions be invalid, the rest of the contract remains valid. The relevant statutory regulations apply in place of the invalid provisions.

 

11.2

All agreements must be made in writing. Verbal declarations on our part are only binding if they have been confirmed by us in writing.
