Terms and Conditions


 

§ 1 Scope

1.1.

These General Terms & Conditions apply to all business relations between you as a customer and us, as does the law of the Federal Republic of Germany.

1.2.
For customers whose domicile or permanent place of residence is outside Germany, these General Terms & Conditions also apply, as does German law, with the exception of the UN Convention on the International Sale of Goods.

 
§
2 Offer and Conclusion of Contract

2.1.
You may place an order for the items presented in the online shop, in our brochure and/or our price lists. Our presentation of these items does not constitute a legally binding offer, but represents a non-binding catalog. Inadvertent errors may occur in the presentation of products and the principle “while supplies last” applies.

2.2.
By clicking the button “Submit order” or sending off an order by e-mail, you are submitting a legally binding offer of purchase for the goods in your shopping cart or those specified in your e-mail. Our confirmation e-mail means that your order has been received by us and has been passed on for further processing, but does not at this point lead to the conclusion of a contract.

2.3.
A purchase contract only comes into effect upon our explicit acceptance of your offer of purchase in the form of an order confirmation sent by e-mail or by our delivery of the goods.

2.4.
For our offers to you with the payment method “payment in advance”, the purchase contract comes into effective upon payment of the stated purchase price in full and on time.

2.5.
We recommend placing orders for alternative items, since only one example of most coins is available. Should a specific item not be available, the customer will receive an alternative of equivalent quality and value, if such a request is made when the order is placed or when we make enquiries. If no delivery is received within 10 days, then the goods requested have already been sold. 

 

§ 3 Cancellation

Cancellation Policy

3.1.
Only consumers as defined under § 13 of the German Civil Code (BGB) have a right of cancellation; commercial customers do not.

Right of Cancellation

You may cancel your contract without specifying the reasons within 2 weeks in writing (e.g. letter, fax, e-mail) or – if the item has been delivered before expiry of this period – by returning the item. The period begins on receipt of your instruction in writing. The timely submission of the cancellation or the goods is sufficient to comply with the terms of this cancellation period. Consequences of Cancellation

In the event of an effective cancellation, any goods and payments received by either party must be returned and any benefits obtained (e.g. interest payments) must be surrendered. If you are unable to return the goods to us either in whole or in part, or you are only able to do so in a deteriorated condition, you must pay appropriate compensation to us. This does not apply in the event of the return of goods if the deterioration is exclusively the result of their inspection – as would have been possible in a shop, for example. In addition you may avoid the obligation to pay compensation for deterioration caused by the proper use of the item by not using the item as your own property and avoiding anything that affects its value.

Items that can be sent by parcel post should be returned at our risk. You must bear the costs of the return if the goods supplied correspond to those ordered and the price of the goods to be returned does not exceed the amount of €40.00 or if, in the event that the price of the goods is higher, you had not yet made the payment in return or arranged partial payment at the time of the cancellation.

Goods that cannot be sent by parcel post will be picked up from you. Obligations to refund payments must be met within 30 days. This period begins for you upon submission of your cancellation or of the goods themselves; it begins for us when we receive the same.


End of Cancellation Policy

3.2.
No right to cancellation exists, in accordance with § 312 d para. 4 no. 6 of the BGB, if our delivery relates to goods, the price of which is subject to fluctuations on the financial market, over which we as a business have no influence and which may occur during the cancellation period.

3.3.
Please avoid exposing the goods to damage and dirt. Return them to us in the original packaging whenever possible, together with all accessories and all parts of the packaging. If you no longer have the original packaging, please ensure adequate protection against damage in transit by choosing suitable packaging; otherwise you will be liable for damage as a result of inadequate packaging.

3.4.
Please return the goods as a registered package to us and retain the proof of delivery. We will gladly reimburse the shipping costs to you in advance if you wish, insofar as these are not to be borne by you.

3.5.
Please note that the conditions specified in sections 3.3. to 3.4 are not prerequisites for exercising your right of cancellation effectively.

 
§ 4 Prices and Shipping Costs

4.1.
All prices and shipping costs are given in euros and include standard-rate sales tax. All deliveries outside the EU are made without payment of tolls, customs duty and import tax (please consult your customs office for further information). However, no sales tax is charged on such items.

4.2.

Shipping costs are calculated according to the contents of the delivery, their value and the type of shipping. Shipping costs are displayed in the online shop in the course of the order process, or you may request notification of them in advance.

€ 20.00 for goods with a value of € 2,500.00 up to € 19,999.00

If cash on delivery is chosen as the method of payment, in addition to the cash-on-delivery fee of € 4.00 the delivery company will charge an extra € 2.00.

§ 5 Delivery, Delivery Periods

5.1.
The goods will be shipped to you as a matter of course; collection from us is only possible with prior arrangement and agreement of date.

5.2.
Shipping will take place within 10 working days of your order; however, if “payment in advance” is chosen as the method of payment, shipping will only take place 10 working days from receipt of your payment.

5.3.
We are entitled to make partial deliveries and perform partial services; the costs of shipping and packaging will only be charged to you once, however.

 
§ 6 Payment

6.1.
You may pay for the goods by invoice, payment in advance, cash on delivery, bank debit or credit card.

6.2.
In the case of payment on invoice or part payments the invoice amount is payable and due immediately upon delivery. In the event of a payment delay, we are entitled to claim the statutory interest for the default amount, plus an administration fee.

6.3.
Should you return the shipment on the basis of the right of return that you are entitled to, any amounts already charged to you will be credited to you.

6.4.
You are only entitled to demand a set-off if your counterclaims have legal force or are undisputed, or if recognized by us in writing.

6.5.
Transaction costs for payments by credit card (VISA Card, Diners Club) are chargeable to you. Currently, the transaction fee for credit card payments is 4.5 % of the gross value of the goods.

6.6.
Payment by installments
Payment by installment mady be made for invoices of EUR 300.00 or higher. Currently, we do not charge interest for payment by installments. Payment by installments is currently possible in up to 6 partial payments.

§ 7 Reservation of Title

The goods remain our property until paid for in full.

 
§ 8 Warranty

The warranty we grant conforms to the statutory regulations.

 
§ 9 Liability

9.1.
We do not accept liability for any slightly negligent breach of duty, unless this relates to duties essential to the contract, damage to life, limb or health as well as guarantees, or where claims under the product liability legislation are involved.

9.2.
No liability can be accepted for consequential losses either, such as loss of increases in value.

9.3.
All links to external sites were checked carefully when this website was created. No potential violations of law were detectable at the time the links were established; we do not accept any liability for external links.

 
§ 10 Data Protection, Credit Check

10.1.
You can visit our site without providing any personal details. We solely store access data that contians no personal reference, such as the name of your Internet service provider, the site from which you visit us, or the file you requested. All this information is analyzed exclusively for the purpose of improving our offer and will not allow any inferences to be made about your person (applies only to Numismatik Shop website).

10.2.
Personal data is only recorded if you provide it to us voluntarily in the course of ordering goods or when you open a customer account or register to subscribe to our newsletter.

10.3.
Your data will be passed on to the shipping company that is commissioned to perform delivery, to the extent that this is necessary for the goods to be delivered. For the purpose of transacting payments, we pass your payment data on to the credit institution commissioned to handle the payment.

10.4.
We use cookies on various pages in order to make visiting our web pages attractive and to facilitate the use of certain functions. These are small text files that are saved on your computer, but most of the cookies we use are deleted at your end once the session has been ended. Other cookies remain on your computer and allow us to recognize your computer when you visit us again. These so-called persistent cookies serve to greet you by your username and save you having to reenter your password or fill in forms when new placing orders.

10.5.
If you have subscribed to the e-mail newsletter, we shall use your name and your e-mail address for our own advertising purposes until you unsubscribe from the newsletter.

10.6.
According to the federal data protection legislation, you have the right to obtain information about the data we store on you as well as a right to demand correction, blocking or deletion of this data, if appropriate, at no expense to you. 10.7.
Should we enter into the process of performing services in advance when you register as a new customer, we will obtain a credit reference on the basis of mathematic-statistical procedures to safeguard our justified interests. The protection of your interests will be taken into account according to the legal regulations. Your data will not be passed on to any third party.

 
§ 11 Final Provisions

11.1.
Should any provision of these General Terms and Conditions be invalid, the contract will otherwise remain valid. The relevant statutory regulations will apply instead of the invalid provisions.

11.2.
All agreements must be made in writing. Verbal declarations on our part are only binding if confirmed in writing.
